Pursuant to Section 1149 of Republic Act No. 10863, otherwise known as Customs Modernization and Tariff Act of 2016, and Customs Administrative Order No. 10-2007 dated November 28, 2007 and other relevant Customs Memorandum Orders, as amended, the following articles/items will be disposed of through NEGOTIATED SALE on an “AS IS, WHERE IS BASIS.”

The said article/s shall be available for inspection on March 7, 2019 at Cancabato Bay, Tacloban City. For further inquiry, please contact the Committee on Negotiated Sale Secretariat Office at telephone no. 526-64-58.

          On March 4, 2019 the Committee on Negotiated Sale shall conduct a pre-bidding conference, to clarify matters concerning the conduct of negotiated sale. All interested offerors are invited to attend.

          Sealed offers to buy indicating the amount of offer, name, address and contact number/s of the offeror should be submitted to the Committee on Negotiated Sale (Attn: Deputy Commissioner for Assessment and Operations Coordinating Group (AOCG) at the Office of the Committee on Negotiated Sale, Secretariat Office at Room No. 310, 3rd Floor, Port of Manila Building, Bureau of Customs, Port Area, Manila on March 11, 2019 before 12 noon. Opening of the sealed offers shall also be held on March 11, 2019, 1:30 P.M. at AOCG Conference Room, Room No. 310, 3rd Floor, Port of Manila Building, Bureau of Customs, Port Area, Manila.

          No offer to buy will be entertained if submitted after the time and date indicated herein.

          Requirements to be submitted simultaneously with the sealed offer:

  1. Tax Identification No. (TIN No.)
  2. Official receipt on the payment of a non-refundable registration fee of P2,020.00.
  3. Latest income and/or Business Tax Returns duly stamped and received by the Bureau of Internal Revenue (BIR) and validated with the payment made thereon.
  4. Government issued ID of the participant/offeror, if with representative, ID of the representative must also be submitted.
  5. For single proprietorship,
  6. Department of Trade and Industry (DTI) registration;
  • Special Power of Attorney of the person authorized to represent, offer and enter into a sale and execute all necessary documents in behalf of the participant/offeror;
  • Affidavit executed by the participant/offeror declaring as follows:

The proprietor or his officers are not related to any of the following:

  1. Within third civil degree of consanguinity or affinity, the Chairperson, member and secretariat of the Negotiated Sale Committee;
  2. The consignee (if applicable) of the seized and forfeited shipments

For partnership, corporation, joint venture and cooperative,

  1. Articles of Incorporation/Partnership and General Information Sheet;
  • Special Power of Attorney (in case of partnership) or Secretary’s Certificate (in case of corporation, joint venture and cooperative), evidencing authority of its representative to offer, enter into sale, and execute all necessary documents in behalf of the participant/offeror;
  • Affidavit executed by the participant/offeror, through its duly authorized representative who shall be either an officer or director, declaring as follows:

None of its officers, directors, members, stockholders, and partners, as the case maybe, are related to any of the following:

  1. Within third civil degree of consanguinity or affinity. the Chairperson, member and secretariat of the Negotiated Sale Committee;
  2. The consignee (if applicable) of the seized and forfeited shipments.
  • The documentary requirements and offer shall be signed in each page thereof and placed in an envelope to be sealed and signed by the participant/offeror.

Failure to submit any of the requirements enumerated above shall automatically disqualify the participant/offeror from participating further in the negotiated sale.

Failure of the offeror/s or his/her authorized representative to be present during the opening of the sealed offers and/or the non-submission of any of the requirements enumerated above shall automatically disqualify the participant/offeror for participating further in the negotiated sale.

The government reserves the right to reject any or all offers, waive and require formalities and accept offers most advantageous to the interest of the government pursuant to Section 1149 of Republic Act No. 10863, otherwise known as Customs Modernization and Tariff Act of 2016 and Customs Administrative Order No. 10-2007, as amended.
